These General Terms and Conditions (“GTC”) apply to all contracts and the use of this website and the case portal of ParkGuard Solutions GmbH in Switzerland. They allow you to request services from third-party providers or directly via the platform. These services are provided or made available under the brands of ParkGuard Solutions GmbH.

When using services provided by third parties, you enter into a contract directly with ParkGuard Solutions GmbH, which acts as a technological intermediary platform. You can request and receive these services via the platform. In some cantons, ParkGuard Solutions GmbH also acts as a provider of towing services.

Please read these GTC carefully. They contain important information about the services offered, your rights, and other relevant details. You enter into a contract with ParkGuard Solutions GmbH, a limited liability company based in Switzerland.

Scope

The website and case portal of ParkGuard Solutions GmbH and their services are always free of charge for you as a user. These GTC govern the relationship between ParkGuard Solutions GmbH and users who use the platform to issue administrative fees for illegally parked vehicles on their parking space or private property. Furthermore, these GTC regulate the management and control of parking spaces as well as the towing of illegally parked vehicles. These services are carried out by ParkGuard Solutions GmbH on behalf of property owners, management companies, facility service providers, or tenants.

Eligibility

The user confirms that they are the owner or tenant of the parking space or private property on which the vehicle was illegally parked.

Amended terms of use

ParkGuard Solutions GmbH reserves the right to amend the GTC at any time. The current version is available on this website.

Parking controls, fuel theft incidents, and administrative fees

Users and, if commissioned, parking guards of ParkGuard Solutions GmbH carry out regular parking controls on behalf of property owners or tenants. In the event of violations of parking rules, an administrative fee is charged. This fee is imposed on illegal parkers and serves to cover the administrative costs incurred.

In addition, ParkGuard Solutions GmbH also handles fuel theft incidents. In every case of non-payment of fuel, an administrative fee is charged in addition to the outstanding amounts to cover processing costs.

Assignment of claims

Customers assign their claims for administrative fees to ParkGuard Solutions GmbH. ParkGuard Solutions GmbH is therefore entitled to collect administrative fees in its own name and for its own account.

Cashback regulation

If agreed, property owners or tenants may receive a rebate (cashback) for collected administrative fees. The amount and conditions of the cashback are determined individually by contract where applicable.

Disclaimer of liability

ParkGuard Solutions GmbH assumes no liability for damages or losses that occurred before the towing of a vehicle or were caused by illegal parking.

Documentation and court injunction

In the case of illegal parking, ParkGuard Solutions GmbH documents all processes, including the collection of geodata and timestamps. Where available, reference is made to a court injunction.

Objection procedure for illegal parkers

Illegal parkers may file a written objection within 10 working days of receiving an invoice or demand for administrative fees, either in the case portal or by email to info@parkguard.io.

Costs

Upon conclusion of the contract, the user assigns their claims for administrative fees to ParkGuard Solutions GmbH by way of assignment. Therefore, no further costs or fees are incurred by the user.

In the case of a blocked vehicle owner inquiry, a fee-based request for vehicle owner information is submitted to the respective canton. These costs, at least CHF 25.00 depending on the canton, are additionally charged to the illegal parker.

Granting access

The user undertakes to provide the towing company with access to the vehicle in order to carry out the service.

Platform availability

ParkGuard Solutions GmbH does not guarantee that the platform will be available at all times or error-free. There may be technical or operational reasons for restrictions.

Data protection

ParkGuard Solutions GmbH processes personal data in accordance with applicable data protection regulations and its own privacy policy. All data is treated confidentially, meets the highest encryption standards, and is stored on servers in Switzerland.

Amendments to the GTC

ParkGuard Solutions GmbH reserves the right to amend the GTC at any time. Changes will be communicated in a timely manner and published on the website.

Applicable law and jurisdiction

These GTC are governed by Swiss law. The exclusive place of jurisdiction is Kloten, Switzerland.
