Introduction

When you view a case in the case portal, contact us or work with us as a business customer, you entrust us with personal data. We are committed to safeguarding that trust.

In this privacy policy, we explain which personal data (“data”) we process, for which purposes, with whom we share it and which rights you have with regard to your data.

Scope

This privacy policy applies to this website and the case portal as well as to the related services of ParkGuard Solutions GmbH (Schaffhauserstrasse 121, 8302 Kloten, Switzerland; hereinafter “we” or “ParkGuard”).

Responsibility

Depending on the context in which your data is processed, a different entity is responsible under data protection law:

• ParkGuard Solutions GmbH is responsible for operating this website and the case portal, for account and user management, security and fraud prevention, and support.
• Enforcement of assigned claims (standard case): Recording cases via the platform requires that the claims be assigned to ParkGuard Solutions GmbH (see the Terms and Conditions). ParkGuard Solutions GmbH pursues these claims in its own name and for its own account and is itself the controller for the associated data processing. This is the standard case.
• Processing on behalf of a client (exception): Where ParkGuard Solutions GmbH processes data for a client in individual cases without an assignment, it acts as a processor on behalf of and according to the instructions of that client, to the extent contractually agreed.

For questions about data protection, you can contact info@parkguard.io at any time. If your request concerns a check on a specific parking area carried out on behalf of a client, we will forward it to that client where necessary.

Which data we process

A. Case data (inconvenience compensation):

• The vehicle's number plate
• Photographs of the vehicle and the parking situation, each with a timestamp
• Location and time data of the check
• Vehicle keeper data obtained from the road traffic office (name, address), where required for invoicing
• Correspondence data in connection with objections, access or deletion requests

B. Payment data:

• Details of the payment of a case: amount, time and status of the payment
• You enter card and account details directly with the payment service provider; we neither receive nor store them

C. Account and usage data:

• Contact details of users and business customers (name, address, email, phone number)
• Usage and device data, e.g. browser, operating system, error and crash reports

D. Communication data:

• Email and chat correspondence with our support
• Recordings of support calls with business customers, provided you were informed of this in advance

Purposes of processing

We process your data for the following purposes:

• Provision of our services: detection of parking violations (through self-reporting or partner companies), documentation, invoicing, payment handling and processing of reimbursements
• Referral to external partner companies for the execution of towing orders (see “Disclosure of data”)
• Customer support, including the handling of objections and enquiries
• Security and fraud prevention, e.g. detection of abusive multiple reports or manipulated information
• Legal proceedings: asserting, defending or enforcing claims and responding to requests from authorities
• Communication about our products and services, unless you have objected or, where legally required, consent has been given

Disclosure of data

We share your data in the following cases:

• With payment service providers: to process online payments in the case portal.
• With postal dispatch providers: name, address and the case documents, where an invoice or a reminder is delivered physically.
• With external partner companies (towing companies): location, number plate and case data, where a towing order is carried out by a partner company rather than by ParkGuard Solutions GmbH itself and this is necessary for executing the order. If ParkGuard Solutions GmbH carries out the order with its own vehicles, no such disclosure takes place.
• With authorities: the road traffic office for vehicle keeper information, law enforcement authorities and courts, where legally required or necessary.
• With debt collection partners: as part of debt collection, where agreed with the respective client.
• With cloud hosting providers: for the technical provision of our services (see “International data processing”).
• With the account holder: where a user obtains services via a third party's business account, e.g. their employer's.

International data processing

ParkGuard Solutions GmbH generally processes and stores data in Switzerland. For individual technical services, in particular cloud hosting, data is also processed on servers within the European Union.

Under the relevant provisions of Swiss data protection law, the EU and EEA states are considered countries with an adequate level of data protection. Processing outside Switzerland and the EU/EEA only takes place if the legal requirements of Art. 16 et seq. of the revised Swiss Data Protection Act (revFADP) are met, in particular through appropriate safeguards such as standard contractual clauses.

Retention period

We generally retain case data for 12 months after the respective case is closed and then delete or anonymise it, unless statutory retention obligations or ongoing proceedings, e.g. an objection, debt collection, court or criminal proceedings, prevent this.

We retain account and usage data for the duration of the user relationship and thereafter within the statutory retention periods.

Your rights

Under applicable data protection law, you have in particular the following rights:

• Access to the data processed about you
• Correction of inaccurate data
• Deletion of your data, unless a statutory retention obligation prevents this
• Restriction of processing
• Objection to processing for marketing purposes
• Delivery of your data in a common electronic format (data portability)

You can exercise these rights via info@parkguard.io. If there are doubts about your identity, we may request a copy of an identity document.

You also have the right to lodge a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC).

Data security

We take appropriate technical and organisational measures to protect your data against unauthorised access, loss or unlawful processing. These include in particular the encryption of data transmission between your device and our servers, role-based access controls and the obligation of our employees and partners to maintain confidentiality.

Additional information for fuel theft cases

The “fuel theft” product is aimed at petrol station operators and concerns cases in which fuel dispensed is not paid for.

In these cases, in addition to the case data mentioned above, we process in particular: details of the petrol station, the amount of fuel dispensed and the outstanding amount. Otherwise, the same purposes, disclosure principles and retention periods apply as for inconvenience compensation case data.

Cookies and error logging

This website uses cookies and comparable technologies. Strictly necessary cookies are required for the site to function and are set without consent; at present the only cookie in this category stores your choice of language, so that the site is presented in that language on your next visit.

We set cookies for analytics, reach measurement or advertising purposes, including those of third-party providers, only with your prior consent. You can give or refuse that consent and withdraw it at any time with effect for the future; refusing has no bearing on your ability to view and pay your case.

To detect and fix technical faults, error and performance data is transmitted to our error logging service — for example the error message, the page visited and the browser used.

Changes to this privacy policy

We may update this privacy policy from time to time. The version published on this page applies. In the event of significant changes, we will also give notice by other means, for example by email. We recommend that you review this page regularly.
